DMCA / IP Complaints
Lingocast respects intellectual-property rights and will respond to clear, well-formed notices that comply with the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. §512), the EU Copyright Directive, and other applicable laws.
If you are a rights holder
To submit a takedown notice, send an email to [email protected] that includes all of the following:
- Your physical or electronic signature, and the name and title of the person submitting the notice.
- Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
- The URL on https://www.lingocast.cc or in the apps that contains the allegedly infringing material, or enough detail for us to locate it.
- Your contact information (address, telephone, email).
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
What happens next
- We acknowledge receipt within two business days.
- We may temporarily disable access to the contested item.
- We forward the complaint to the user who submitted the source.
- If a user files a counter-notice we may restore the item after the statutory period unless you bring legal proceedings.
Counter-notices
If you believe content was removed in error, send a counter-notice to [email protected] including (a) your signature and contact information, (b) identification of the removed material and where it appeared, (c) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and (d) consent to jurisdiction of the federal district court for the area in which you live (or, if outside the US, of Hong Kong).
Publisher feed requests
Lingocast responds to rights-holder requests about both public source feeds and private user-submitted feeds. If you are a publisher and believe a feed is being processed without permission, contact us at [email protected] with the feed URL, your organisation's name, and your contact details. We may suspend processing of the feed while reviewing the claim.
Repeat infringers
Accounts that receive multiple substantiated complaints will be terminated.
False notices
Knowingly misrepresenting that material is infringing may result in liability for damages under 17 U.S.C. §512(f).
